  • Changes to planning under the Growth and Infrastructure Act

    The Growth and Infrastructure Act 2013 introduces measures to reduce red tape that delays business investment, housing development, new infrastructure and job creation.  Changes to the planning regime under the Act include;


    - A provision which for 3 years allows developers to renegotiate section 106 agreements which have made housing schemes economically unviable


    - Developers will be able to submit planning applications directly to the Planning Inspectorate where the relevant local authority has consistently failed to meet statutory requirements to consider applications on time


    - A limit on the information a local authority can require to be submitted alongside a planning application


    - Removal of over-lapping development consent regimes that require multiple extra permissions from different government agencies


    - For town and village greens, restricts when registration applications can be made, the existing strong protection for registered greens is unchanged


    - Introduces new permitted development right for change of use and small-scale extensions
