It is clear that FMB members are facing more legal issues than ever before as clients and employees become increasingly aware of their legal rights. Legislation is changing all the time making it difficult for businesses to keep up with all the requirements. The current economic climate has added to this, with more debt-related problems and a rising number of employment disputes.


This legal expenses cover helps you to meet the cost of taking legal action or defending your rights if you have a dispute with another party by providing insurance designed to meet these costs. The cover goes well beyond the limited legal defence cover that you may find under your liability insurance. Just consider the following…

 

  • An employee issues proceedings against you in an employment tribunal,
  • The police make enquiries into your business, or conduct checks into the legal status of your employees
  • The Health & Safety Executive investigates an accident for which you may be held responsible, leading to a possible prosecution
  • HM Revenue & Customs advises that it will be conducting an enquiry into your business accounts, or
    re-assessing your VAT return
  • You are unable to gain access to your site due to a third party causing a legal nuisance, or travellers are residing on land which you intend to develop
  • You need to take action against a third party for injury, or recover compensation for damage caused to your property.

DAS will appoint a solicitor or accountant to act on your behalf, so you can be assured that the necessary expertise is on your side. The solicitor or accountant will first review the circumstances of your case and advise whether you have a good chance of taking matters forward. Most elements of the cover carry a £100,000 limit of indemnity to cover the legal costs involved.

 

Don’t Walk Away From Bad Debts
Assistance with overdue debts and customer complaints

We all encounter difficulties with certain customers, some relating to non-payment and others who choose to complain over the service they have received. The policy provides Debt Recovery assistance in resolving uncontested debts with customers. Overdue payments soon have an adverse effect on the cash flow of a business, and representation by a DAS appointed solicitor can help to bring matters to a swift conclusion.

 

FMB Adjudication Procedure

This tailored policy will also provide support alongside the FMB’s RICS Adjudication Procedure, indemnifying costs which may be awarded against you. You can therefore be confident about committing to the service knowing that any apportionment of costs (up to £1,100) will be covered under this policy. Furthermore, if RICS rule in your favour, but your customer refuses to accept their adjudication, DAS will take action to enforce the decision through a summary court judgement.

The cost of this policy to the FMB is much less than could be secured in the open market because it is being provided for all members (excluding Associate, Affiliate and Retired Members).
